Everything You Need to Know About Driving on Suspended in Virginia

What it Means to Have a Suspended License 

 

In Virginia, a license can be suspended for many different reasons, including: failing to pay fines for court or a prior ticket; a reckless driving conviction; having too many points on your license due to traffic violations; failing to pay child support, jail fees, or a judgement against you from a motor vehicle crash; not maintaining insurance on your vehicle or failing to pay the state’s uninsured motor vehicle fee; a health condition that affects your ability to drive (i.e. seizures, impaired vision, or a loss of motor function). 

Penalties for Driving with a Suspended License

If you are charged with driving with a suspended license in Virginia, it could result in fees and jail time, further loss of driving privileges, and/or having your vehicle impounded. Driving with a suspended license is a serious misdemeanor. VA Code § 46.2-301. Additionally, when convicted of driving with a suspended license, you will receive another suspension equal to the one you originally received.

 

Defenses for Driving with a Suspended License

 

If there was an issue with timing or paperwork that proves that legally, your license was not suspended at the time you were pulled over, if you had not been notified that your license was suspended, or if the police did not have a legal reason to pull you over (a “reasonable articulable suspicion”), you have a good chance of getting the charges dropped with the help of an experienced defense attorney. 

 

Additionally, a judge may be willing to give you an extension if you are making a sincere effort to pay your fines and take the steps necessary to reinstate your license, but this approach is most effective with an attorney. The judge may dismiss your charge if you can get your license reinstated.
